The $400k, TV & Radio Rights

Dave Reardon writes that Herman Frazier acknowledged in an e-mail to June Jones in December that JJ wouldn't have to pay the $400k penalty if he left UH early. However, it seems it was never put in the contract. And to UH, that's what matters.
But while that may indicate Frazier was willing to let Jones go without a buyout, language in the contract indicates it doesn't meet the standard needed to change the deal.

According to paragraph 17.0 of the contract, "This Agreement contains all the terms between the parties and may be amended only in writing signed by both parties."
Leigh Steinberg tells Dave that JJ sacrificed a lot and tried to help UH financially while he was head coach. Frazier was not available for comment.

Ferd Lewis writes that while SMU could schedule a game at Hawaii under the "Hawaii exemption," allowing them an extra game during the regular season, they've told UH that their schedule is full for the next ten years. Nice.

In his column, Ferd Lewis writes SMU's "next ten years" answer has to do with the disputed $400k. But he offers what I think is an awesome solution to this problem.
Here's how you settle it. Square off at Aloha Stadium in a 2009 game with added incentive the kind of reality challenge college football has never seen:

If UH wins, Jones pays up at midfield after the game with one of those 5-foot cardboard checks. If SMU prevails, Jones gets to tear up the contract at midfield.

Think that would pack the stands and grab TV's attention?
Hell yeah. Why not? Seriously, I think it's a great idea. Have Michael Buffer do the intros! June would be all for it, I'm sure. I've never known a Texan to back down from a fight.

And Brian McInnis talks to Jim Donovan, who has an update on TV and radio contract negotiations.
"We have talked to the current contractor in radio and come to an agreement in principle," Donovan said. "But we don't want to sign anything, pending the television deal being completed."
While he wouldn't go into specific sticking points of the TV negotiations, some form of three-way contract extension with current rights-holder KHNL/KFVE and Oceanic Time Warner Cable (which provides Pay-Per-View service for football and other sports) is possible.

    I have some comments about the quote above.

    1. This email is just before UH plays Georgia in the Sugar Bowl held about a week later. The timing is crucial as JJ should have been prepping the team to play in the most important game UH has been in. Did JJ do his best in prepping the team and did he do any adjustment during the game against Georgia's defense? I didn't think so. Would he be able to leave if UH won--or said another way, was it easier to leave if UH lost?

    2. Another example of Frazier's incompetence. Did he not even consider why JJ's agent would be interested in getting that email? Why didn't he even try at that point to correct his own shortcomings? I should say that I am very happy with the hiring of Coach Mack and Jim Donovan--but I am still frustrated with anything the Frazier did or should I say what Frazier never did.

    3. I have a variation on Ferd's solution. If UH is short one game and SMU agrees to play in Hawaii, would the profits from the 13th game due to the Hawaii exemption, provide Hawaii with at least $400,008 which is what JJ owes? But of course they cannot cancel the game or said another way, SMU must show up or consider a penalty of say double that $400,008.

    tombo great stuff.

    No matter what JJ or his agent says they did not amend the contract. Fraizer's e-mail is not binding on UH. In fact, UH should file a lawsuit against Fraizer for the e-mail where he had no apparent authority to send the e-mail. Heck, may be Fraizer should pay Jones and then Jones pays UH.

    Fuzzy good idea. Also, SMU does not get any money from us to attend the game. They gotta do it at their own cost. SMU is just playing games that they are not available. Does that sound familar with about a former coach?

    If SMU is witholding a UH game over the 400K JJ owes, that's just childish.

    But in the end, why should we even care about SMU? The June Jones era is over, and we have nothing to gain from beating SMU. I'd rather have us play BYU and start up that rivalry again.

    I agree with fuzzy, I don't really think the Sugar Bowl game was coached well, starting from the lackluster locker room speech to a lack of creativity or flexibility on offense, despite having weeks to prepare.

    June Jones is a great coach, but he was obviously distracted by everything. If he wants the people of Hawaii to continue to show aloha to him, he should just pay up so we can all move on.

    yeah, certainly wish june wasn't talking to smu leading up to the sugar bowl. i can't imagine he'd be any less prepared to face georgia because of it, but i'm sure it didn't help.

    so did anyone get the texas reference in today's post? background is in this dave reardon article from eight years ago.

    Hi Tombo, good reference to a long time ago. But JJ was not born in Texas either so does that mean he can back out of this fight?

    By the way, how long has this site been running? I think I only knew about it in maybe 2006 or early 2007--I wish I knew about it earlier.

    Still waiting for Patek and Lafaele--they deserve to play at the next level.

    Somehow I think the loss to Georgia in the Sugar Bowl reduced the chances of UH players getting drafted.

    i started posting in 2004, but i'm glad you weren't reading back then -- just a lot of swearing and trying to be clever. kind of like now, but with less swearing.

    i thought i read that lafaele might get a shot after the first round of free agents are cut from nfl teams, don't hold me to that though. i haven't heard anything about patek.

    Eh, there is nothing wrong with swearing especially if its at JJ for not paying up.

    I agree with franks about SMU/BYU. Lets forget SMU and concentrate on BYU. I would like to see UH grill BYU cougars on the habachi. Whenever UH had a decent team the stadium was sold out. I still remember Gabrielle (sp.) lighting up Detmer, and Rolo putting up 72 against BYU.
